Early identification of active and passive claims

A focused review of the contract, programme, correspondence and project records to identify both the claims that should be pursued (active) and the exposure to claims that may be brought against the client (passive). Early detection preserves entitlement, protects evidence and gives clients time to make informed strategic decisions.

Claims strategy and substantiation

Definition of the claim's contractual basis, the supporting evidence required, the cause-and-effect chain, the heads of loss and the appropriate quantification approach. The aim is a strategy that is contractually defensible, properly evidenced and aligned with the client's commercial objectives.

Construction claims drafting

Preparation of structured claim documents — including notices, particulars, supporting narratives and detailed appendices — that present entitlement, causation, effect and quantum in a clear, persuasive and contractually grounded manner. Each document is built to withstand scrutiny by the other side, the engineer or a tribunal.

Delay and disruption analysis

Programme analysis, time impact assessment and the application of recognised delay analysis methodologies for extension of time and disruption claims. The output is technically robust, contractually compliant and presentable in negotiation, adjudication or arbitration.

Assistance in claims negotiation

Direct support during negotiation rounds, including preparation of negotiation positions, response strategies, settlement scenarios and the supporting analytical material needed at the table. We aim to maximise recovery (or minimise exposure) without unnecessary escalation.

Support in adjudication and dispute resolution

Specialist input through Dispute Boards, adjudication, mediation and the early stages of arbitration. PMCC International provides technical, contractual and quantum support, working alongside the client's legal team where one is appointed.

Contract & Risk

Contractual advice and risk management.

Many disputes can be reduced or avoided altogether through earlier and better contract management. We help clients prepare, draft and administer contracts so that risk is allocated clearly and entitlement is protected.

Contractual advice and contract drafting

Review and drafting of construction and EPC contracts, special conditions, subcontracts and supply agreements. Particular attention to risk allocation, notice and time-bar provisions, variation regimes, payment mechanisms, termination, liability caps and liquidated damages. Practical guidance on the operation of FIDIC and other standard forms.

Risk management

Identification, assessment and tracking of contractual, programme, technical and commercial risks at the relevant stage of the project. Practical mitigation measures and clear reporting that allows project leadership to act before issues become disputes.

Project Management Support

Hands-on support for live projects.

Sometimes a project needs experienced specialist input on a temporary or part-time basis. PMCC International provides project management cover and planning support tailored to the engagement.

Temporary project management assistance

Interim or part-time project management cover for projects requiring senior support, particularly during critical phases such as start-up, handover, commissioning, claims management or project recovery. Engagements are scoped to what the project actually needs.

Project planning support

Programme preparation, review and update; baseline analysis; critical path management; progress reporting; recovery planning. We work with the project team and the appointed planner to bring rigour and contractual awareness to programme management.

Knowledge transfer and in-house seminars.

Many of the most expensive disputes start with avoidable mistakes in contract administration. Targeted training is one of the most cost-effective forms of risk management available to a project organisation.

Tailored training programmes and seminars on construction claims, contractual entitlement, FIDIC operation, notice and time-bar discipline, programme management, variations and dispute avoidance. Sessions are designed for project managers, contract managers, planners, commercial teams and engineers, and are adjusted to the project, the contract form and the level of the audience.
